Application of the new German WEEE-Legislation (ElektroG2) to the category Lighting Equipment
Producers that put on the market lamps and/or luminaries and were affected by the legislation amendment (see News of 24th September 2015 and 19th November 2015) were given the choice to file an application for continuance with stiftung ear.
According to the transition regulations of ElektroG2, affected producers that have applied for continuance can continue to report their sales in the same categories as before – a.i. already registered LED-lamps under category 5.2 “Luminaries and other lighting equipment or devices for the dispersion of light”.
The definitive implementation of the law will take place on the 1st of January 2017. Due to this, stiftung ear is requesting a reply on this subject until 31st August 2016, as to which of the following cases applies to you:
Registrations for category 5.2 “Luminaries and other lighting equipment…” may be cancelled from January 2017 on, if you only sell loose LED-lamps, which will hereafter fall under category 5.1.2 “Lamps, except gas discharge lamps”.
Registrations for category 5.2 “Luminaries and other lighting equipment…” shall remain valid if category 5.1.2 “Lamps, except gas discharge lamps” is registered and invoiced additionally, if you sell loose LED-lamps and whole luminaries.
