Austria has a new Battery Regulation, which came into force on 8 July 2021 and thus implements the Europe-wide Circular Economy Package at national level.
The most important changes in the amended ordinance are:
Commissioning an authorised representative for foreign distance sellers and manufacturers of batteries from 1 January 2022; and
additional information and take-back obligations for final distributors of portable batteries on free take-back (placed clearly visible in the shop).
Who needs an authorized representative?
Distance sellers or online traders who deliver directly to end consumers will need an authorised representative in Austria from 1 January 2022.
Foreign manufacturers who supply Austrian dealers and thus indirectly place batteries on the market in Austria will need an authorised representative in Austria from 1 January 2022.
