The amended Electrical and Electronic Equipment Act ElektroG3 has been in force since 1.1.2022 and entails the first innovations for manufacturers and dealers of electrical equipment.
The take-back concept now comes into play, for manufacturers of appliances that are exclusively for commercial or professional use (B2B appliances). With this obligation, these market players are to fulfil their extended producer responsibility.
What must the take-back concept contain?
Declaration on the establishment of return options, i.e. e.g. a description of the concrete design of the return option; declaration on the content of already existing disposal contracts.
If you have commissioned one (or more) third parties, their contact details including name and address are required.
Information on the contact details of the person with whom the return can be registered, to explain the access option for the end user incl. information on company name, contact person, telephone number and e-mail address.
You are not yet registered with stiftung ear?
In order to obtain registration for the German market, since 1.1.2022 you have to present a take-back concept to stiftung ear in addition to the prima facie evidence even before placing your B2B equipment on the market – and this already during the initial registration.
Are you already registered with the stiftung ear?
A transitional period applies to already existing registrations. You must subsequently deposit the take-back concept in the ear portal by 30.06.2022. Otherwise, your authorization could be revoked.
