Further ElektroG amendments from 2023 onwards
Edit: On November 25, 2022, the ElektroG4 bill passed the Bundesrat, meaning that two amendments are to come into force as early as January 1, 2023.
Edit 2: As reported by stiftung ear, boilers and hot water tanks remain in category 1 after protests from disposal companies and at the request of the Bundesrat.
The extended responsibility for Marketplace operators and fulfillment service providers will be postponed until July 1, 2023. The regulation, which was introduced with the ElektroG3 and was originally scheduled to take effect on January 1, 2023, prohibits Marketplace operators from allowing unregistered manufacturers and dealers to offer electrical equipment on their platform. Similarly, fulfillment service providers are not allowed to provide storage, packaging, addressing or shipping for manufacturers and retailers that are not properly registered. The reason given for postponing the deadline is the large number of registration applications received by stiftung ear.
Dropped: Annex 1 of the ElektroG, which gives examples of appliance classification, stipulates that boilers and water heaters must in future be registered and reported as small or large appliances rather than as heat exchangers. Affected manufacturers should take this into account when reporting their planned quantities and submit (or have submitted) any necessary registration applications in good time.
In addition, a further amendment to the ElektroG is currently being considered. The focus here is on the goal formulated in the coalition agreement of establishing an incentive system for the disposal of electrical appliances and lithium-ion batteries in order to increase the collection rate. A draft law is expected in summer 2023.
